A resident of Gütersloh receives a significant jail term for sexually assaulting his 11-year-old niece.

In a landmark decision, the III. Large Criminal Chamber - a youth protection chamber - of the Bielefeld District Court has sentenced Cezary O. to five and a half years in prison for the severe sexual abuse of his niece, Denise. The trial, which lasted for three months, saw the defendant deny the allegations throughout.

The abuse took place primarily at the parents' home in Herzebrock-Clarholz, in the basement, marital bed, and child's room. On three occasions, Cezary O. showed the girl films with child pornographic content.

The court's decision was based on the fact that Cezary O. committed the acts when he was babysitting Denise and took advantage of the trust relationship, but he did not use violence against his niece. This ruling, however, acquitted the defendant in some cases.

Defense lawyer Lars A. Brögeler, representing Cezary O., has announced his intention to appeal the decision to the Federal Court of Justice. The verdict for Cezary O. is not yet final due to the upcoming appeal.

It is important to note that Cezary O. had previously requested an acquittal for himself. The public prosecutor's office, however, had called for a multi-year prison sentence in its closing argument.

The victim, Denise, was eleven years old at the start of the abuse, which occurred over a period of one year, from summer 2018 to summer 2019.

In a surprising turn of events, despite the expectation of a multi-year prison sentence, Cezary O. appeared for the verdict. It is currently unclear where Cezary O. is, as he is currently at large.

The Higher Regional Court in Hamm had previously suspended the arrest warrant against Cezary O. following a complaint by his Dortmund lawyer, Lars A. Brögeler. However, the details of this suspension are not publicly available.
