The young patient, who requested a general anesthesia for the treatment despite suggestions for alternative methods, experienced a cardiac arrest during a multi-hour appointment and later passed away in a hospital. The initial verdict for the anesthesiologist resulted in a one-year and six-month suspended prison term for bodily harm resulting in death, while the dentist was acquitted in July 2024.

However, the BGH has determined that the Hamburg Regional Court did not consider the dentist's potential involvement in the long operation and communication with the anesthesiologist about the surgery's extended duration. The court also believed that the anesthesiologist may have made a mistake of law in sentencing, regarding the necessary medical equipment for monitoring the patient during the surgery.

As a result, the BGH has ordered a reconsideration of the anesthesiologist's sentence and a retrial of the dentist's case. The public prosecutor's office appealed against the first verdict, and the defendant appealed against the second.

The case has sparked significant interest, with the Hamburg Regional Court expected to restart the dentist's trial from scratch. It is important to note that the anesthesiologist's trial will not be reopened, but the sentence may be reduced.
